These Terms & Conditions (the "Terms") govern your access to and use of ClassAdapter Pro (the "Service"), a web application operated by Joanne Johnson ("we", "us", or "our"), trading as ClassAdapter Pro. By creating an account or otherwise using the Service, you ("you" or the "user") agree to be bound by these Terms.

1. Acceptance of these Terms

By accessing, browsing, or using the Service in any way, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the Service. If you are using the Service on behalf of a school, district, or other organization, you represent that you have authority to bind that organization. If you are an individual, you represent that you are of legal age to form a binding contract in your jurisdiction.

2. The Service

ClassAdapter Pro is an AI-powered tool that helps educators adapt instructional texts — simplifying, translating, generating vocabulary scaffolds, task lists, and related materials — based on inputs you provide (uploaded files, URLs, or pasted text).

3. Your account

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • upload content you do not have the right to upload, or that infringes intellectual property, privacy, or other rights;
  • upload content that is hateful, harassing, sexually explicit involving minors, or otherwise prohibited by applicable law;
  • attempt to interfere with the security or integrity of the Service (including probing, scanning, scraping at scale, or introducing malware);
  • reverse engineer, decompile, or attempt to extract the source code of the Service except as permitted by law;
  • resell, redistribute, or sublicense the Service or its outputs as a standalone product;
  • circumvent usage limits, plan restrictions, or other technical controls.

5. AI-generated content

The Service uses third-party large language models to generate adaptations, translations, vocabulary scaffolds, and other outputs. You acknowledge that:

  • AI outputs may contain inaccuracies, omissions, or errors and should be reviewed by a qualified educator before classroom use;
  • outputs are not a substitute for professional, medical, legal, financial, or other regulated advice;
  • you are responsible for your prompts and inputs, for verifying the accuracy of outputs, and for ensuring you have the rights to any source material you submit;
  • we may remove or restrict content, refuse or filter outputs, and suspend accounts that repeatedly violate these Terms or applicable law;
  • if you believe content generated through your account infringes your rights, you may contact us to request a takedown; repeat infringers may be terminated.

6. Your content

You retain ownership of the source material you upload and the outputs generated for your account. You grant us a limited, non-exclusive, worldwide license to host, process, and display your content solely for the purpose of operating and improving the Service.

7. Intellectual property

The Service itself — including its software, design, branding, and documentation — is owned by Joanne Johnson and protected by applicable intellectual property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable right to use the Service for your own teaching and educational purposes within your chosen plan.

8. Payments and subscriptions

Paid plans are sold through our online reseller, Paddle. Payment, billing, taxes, cancellations, and refunds are governed by Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled before renewal.

Merchant of Record disclosure. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service availability

We work hard to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or free from security vulnerabilities. We may modify, suspend, or discontinue features at any time.

10. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our acceptable-use rules. You may stop using the Service at any time. On termination, your right to use the Service ends, and we may delete your account data after a reasonable period.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service shall not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, or death or personal injury caused by negligence).

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the Service or by email. Your continued use after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Joanne Johnson resides, without regard to its conflict-of-laws rules. Disputes shall be brought before the courts of that jurisdiction, except where applicable consumer-protection law requires otherwise.
